Vidsmia Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of Vidsmia (the "App" or "Service"), operated by GO LIVE DEAL INC ("GO LIVE DEAL," "we," "us," or "our").

By creating an account, accessing, or using Vidsmia, you agree to these Terms. If you do not agree with these Terms, do not use the Service.

1. About Vidsmia

Vidsmia is an AI-powered video-generation application that allows users to submit text prompts and generation settings and receive AI-generated video content.

Vidsmia uses third-party technology and infrastructure to provide AI generation, authentication, payment processing, hosting, and other functionality.

Because AI systems are probabilistic, generated content may be inaccurate, unexpected, incomplete, unsuitable, or similar to content generated for other users.

2. Eligibility

  • You must be at least 16 years old to use Vidsmia.
  • You must also have the legal capacity required by the laws applicable to you to enter into these Terms.
  • If you are under the age of majority where you live, you may use Vidsmia only with the permission and involvement of a parent or legal guardian where required by applicable law.
  • You may not use Vidsmia if applicable law prohibits you from doing so.

3. Your Account

Some Vidsmia features require an account. You agree to:

  • Provide accurate information when creating your account.
  • Keep your account information reasonably current.
  • Protect access to your account.
  • Not share your account credentials in a way that compromises account security.
  • Notify us if you believe your account has been accessed without authorization.

You are responsible for activity occurring through your account unless caused by our failure to reasonably protect the Service.

4. AI Generation

Vidsmia allows you to submit prompts and generation settings to create AI-generated videos. AI-generated content is produced using third-party AI systems. Because of the nature of generative AI:

  • Results may vary between generations.
  • Results may be inaccurate or unsuitable.
  • Results may not match your prompt exactly.
  • Results may contain unintended elements.
  • Similar or identical outputs may be generated for different users.

We do not guarantee that generated content is unique, factually accurate, or free from third-party intellectual-property rights. You are responsible for reviewing generated content before using, publishing, distributing, or relying upon it.

5. Your Prompts and Content

You retain your rights in content that you submit to Vidsmia, subject to the rights necessary for us and our service providers to process that content and provide the Service.

By submitting a prompt or other content to Vidsmia, you grant GO LIVE DEAL INC and the service providers we use a limited right to process, transmit, store, reproduce, and otherwise handle that content as reasonably necessary to:

  • Provide the requested Service
  • Generate your requested video
  • Store and display your generation history
  • Maintain and secure the Service
  • Troubleshoot and improve the reliability of the Service
  • Comply with applicable law

This permission ends when it is no longer reasonably necessary for the purposes above, subject to legitimate retention requirements and third-party provider policies. You represent that you have the necessary rights and permissions to submit content to Vidsmia.

6. AI Output

To the extent permitted by applicable law, you may use generated videos produced through your Vidsmia account for lawful purposes, subject to these Terms and any applicable third-party rights or restrictions.

  • We do not guarantee that you will receive exclusive rights to a generated video.
  • AI-generated content may be similar or identical to content generated for another user.
  • You are responsible for determining whether your intended use of generated content complies with applicable laws and third-party rights, including copyright, trademark, publicity, privacy, and other intellectual-property rights.
  • Nothing in these Terms guarantees that a particular generated video is copyrightable or exclusively owned by you.

7. Prohibited Uses

You may not use Vidsmia to:

  • Violate any applicable law or regulation.
  • Infringe, misappropriate, or violate another person's intellectual-property, privacy, publicity, or other rights.
  • Impersonate another person in a deceptive or unlawful manner.
  • Fraudulently misrepresent the origin or authenticity of content.
  • Submit passwords, authentication credentials, payment information, or other highly sensitive information as generation prompts.
  • Attempt to gain unauthorized access to Vidsmia or another person's account.
  • Interfere with or disrupt the Service.
  • Circumvent generation limits, subscription restrictions, rate limits, or other technical controls.
  • Reverse engineer or attempt to extract proprietary source code, models, credentials, or secrets from the Service except where applicable law expressly permits it.
  • Use automated systems to abuse or overload the Service.
  • Resell or sublicense access to Vidsmia without our written permission.
  • Use Vidsmia for unlawful, fraudulent, or abusive purposes.
  • Upload or submit content that you do not have the right to use.

We may suspend or terminate accounts that violate these Terms or present a security, legal, or operational risk.

8. Subscription Plans

Vidsmia may offer free and paid subscription plans.

  • Current plans and pricing are displayed within the App or applicable purchase interface.
  • Paid plans may provide a specified number of generations and/or generation units during a billing period.
  • Your available generations and units are subject to the limits associated with your selected plan.
  • We may change plan features, limits, or pricing in the future. Where required by applicable law or the applicable payment platform, we will provide notice before material changes take effect.

8. Billing and Payments

  • Paid subscriptions are processed through the applicable payment platform, including Stripe where applicable.
  • Payment information is processed by the payment provider rather than stored directly by Vidsmia.
  • By purchasing a subscription, you authorize the applicable payment provider to charge the applicable subscription fees according to the terms displayed at purchase.
  • Subscription billing may automatically renew unless canceled according to the applicable cancellation process.
  • You are responsible for maintaining valid payment information.

9. Cancellation

You may cancel your paid subscription using the subscription-management or billing-portal functionality provided by Vidsmia.

Cancellation generally prevents future renewal while allowing access to paid features through the applicable remainder of the paid subscription period, unless otherwise stated at the time of cancellation.

Deleting your Vidsmia account may also cause an active paid subscription to be canceled.

9. Refunds

Refund eligibility depends on the applicable purchase method, payment platform, applicable law, and the circumstances of the transaction.

Where a payment was processed through a third-party payment provider, that provider's applicable payment and refund procedures may apply.

Nothing in these Terms limits any refund or cancellation rights that cannot legally be waived under applicable law.

10. Generation Units and Usage Limits

Vidsmia may use a unit-based system to account for the computational cost of different generation options.

  • Different AI models, video durations, or generation settings may consume different numbers of units.
  • The unit cost displayed by Vidsmia at the time of generation is the applicable cost for that request, subject to technical corrections or adjustments required to address an error.
  • We may impose generation limits, rate limits, or other reasonable restrictions to protect the Service from abuse and maintain availability.
  • Unused generations or units do not have cash value unless required by applicable law.

11. Failed Generations

Vidsmia attempts to handle failed or incomplete generations appropriately.

However, technical failures may occur because of network problems, third-party AI infrastructure, server errors, capacity limitations, or other circumstances outside our control.

Where our systems determine that a generation failed before completion, Vidsmia may restore or refund the applicable reserved generation resources according to our internal accounting rules. We do not guarantee that every generation request will succeed.

12. Availability and Changes to the Service

  • We may modify, suspend, or discontinue all or part of Vidsmia at any time.
  • We may perform maintenance, upgrades, or changes to the Service.
  • We do not guarantee that Vidsmia will always be available, uninterrupted, error-free, or compatible with every device.
  • Third-party services used by Vidsmia may also experience outages, limitations, or changes that affect the Service.

13. Third-Party Services

Vidsmia relies on third-party providers including authentication, payment, AI-generation, database, hosting, and application-development infrastructure providers.

Those providers may have their own terms and privacy policies. For example, Vidsmia currently uses:

  • Clerk for authentication
  • Stripe for payments
  • fal.ai for AI generation
  • Supabase for database infrastructure
  • Vercel for backend hosting
  • Expo-related services for application development and distribution

We are not responsible for independent services or websites operated by third parties.

14. Intellectual Property

Vidsmia, including its software, interface, branding, logos, design, and other original materials provided by GO LIVE DEAL INC, is owned by or licensed to GO LIVE DEAL INC and is protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from Vidsmia or its proprietary components.

These Terms do not transfer ownership of GO LIVE DEAL INC's intellectual property to you.

14. User Feedback

If you voluntarily provide suggestions, ideas, feature requests, or other feedback about Vidsmia, you grant GO LIVE DEAL INC permission to use that feedback without compensation or restriction for purposes of improving or developing the Service.

We will not treat your feedback as confidential unless we expressly agree otherwise.

15. Privacy

Your use of Vidsmia is also governed by our Privacy Policy.

The Privacy Policy explains what information Vidsmia collects, how it is used, the third parties involved, retention practices, and account-deletion procedures.

15. Account Suspension and Termination

We may suspend, restrict, or terminate your account if:

  • You violate these Terms.
  • You engage in fraudulent or abusive activity.
  • You attempt to circumvent usage or payment controls.
  • Your activity creates a security or legal risk.
  • We are required to do so by law.
  • We discontinue the Service.

You may stop using Vidsmia and delete your account at any time. Termination does not automatically eliminate obligations or rights that by their nature should survive termination.

16. Account Deletion

You may delete your Vidsmia account through the App or through the external account-deletion mechanism provided by Vidsmia.

When your account is deleted, we will initiate deletion of the Vidsmia account data described in our Privacy Policy:

  • Active paid subscriptions are canceled where applicable.
  • Your Vidsmia generation records are deleted.
  • Applicable usage records are deleted.
  • Your Vidsmia subscription record is deleted.
  • Your account is deleted through our authentication provider (Clerk).
  • Applicable locally stored Vidsmia application data (including generation history stored in AsyncStorage) is cleared.
  • You are signed out of Vidsmia.

Third-party providers may retain information where permitted or required by their own policies, contracts, or applicable law. Content independently saved to your device is not deleted by deleting your Vidsmia account.

17. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIDSMIA IS PROVIDED "AS IS" AND "AS AVAILABLE."

WE DO NOT GUARANTEE THAT:

  • THE SERVICE WILL ALWAYS BE AVAILABLE;
  • THE SERVICE WILL BE ERROR-FREE;
  • GENERATIONS WILL ALWAYS COMPLETE;
  • GENERATED CONTENT WILL BE ACCURATE;
  • GENERATED CONTENT WILL BE UNIQUE;
  • GENERATED CONTENT WILL BE APPROPRIATE FOR YOUR PARTICULAR PURPOSE;
  • GENERATED CONTENT WILL NOT INFRINGE THIRD-PARTY RIGHTS; OR
  • THE SERVICE WILL MEET EVERY PARTICULAR REQUIREMENT OR EXPECTATION.

YOU ARE RESPONSIBLE FOR REVIEWING AND VALIDATING GENERATED CONTENT BEFORE USING OR DISTRIBUTING IT.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GO LIVE DEAL INC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF VIDSMIA.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GO LIVE DEAL INC'S TOTAL LIABILITY ARISING FROM OR RELATED TO VIDSMIA WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID TO GO LIVE DEAL INC FOR VIDSMIA DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. ONE HUNDRED U.S. DOLLARS (US $100).

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

17. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless GO LIVE DEAL INC and its officers, directors, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from:

  • Your violation of these Terms;
  • Your unlawful use of Vidsmia;
  • Your submitted content;
  • Your use or distribution of generated content; or
  • Your violation of another person's rights.

This provision does not apply to the extent that a claim results from GO LIVE DEAL INC's own conduct that cannot legally be shifted to you.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles, except to the extent that applicable law requires otherwise.

Nothing in these Terms is intended to waive or limit any rights or protections that cannot legally be waived under applicable law.

17. Dispute Resolution

Before initiating formal legal proceedings, you agree to contact us at admin@golivedeal.com and provide a reasonable opportunity to resolve the dispute informally.

Nothing in this section prevents you from exercising rights that cannot legally be waived or restricted by contract.

18. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may provide notice through the App, website, email, or another reasonable method where required by applicable law.

Your continued use of Vidsmia after the updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

17. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

18. Entire Agreement

These Terms and the Vidsmia Privacy Policy constitute the agreement between you and GO LIVE DEAL INC regarding your use of Vidsmia, except where additional terms are expressly presented for particular features or purchases.
